Terms & Conditions

"THE LODGE" is a trading style of The Lodge Partnership. Partners Stuart Wilson & Deborah Harrison.

1. Interpretation In these conditions

'Goods' means the goods subject of the Contract; 'Customer' means the person, firm or company with whom the Contract is made by the lodge; 'The Contract' means the Contract for the sale or supply of the Goods or services.

2. General

These conditions shall apply to the Contract to the exclusion of any other terms or conditions contained or referred to in any order, letter, form or Contract sent by the Buyer to the Company and the provisions of these conditions shall prevail unless expressly varied by agreement in writing and signed by a partner on the business's behalf.

3. Orders

Not with standing any detailed quotation of the The Lodge no order shall be binding on the Lodge unless accepted in writing by the Lodge.

4. Prices

a. the price payable for the Goods & Services shall be the prices of the Lodge current as detailed on the website, unless otherwise contracted.
b. The Lodge reserves the right to issue new price lists at any time without prior notice.
c. All prices are exclusive of Value Added Tax which will be charged at the appropriate rate. This is subject to The Lodge being required to register for VAT.
d. The price of the Goods shall be due in full to the Lodge in accordance with the contract and the Buyer agrees not to exercise any set-off, lien, or any other similar right or claim whether in respect of any alleged defect in the Goods or services  or otherwise.

5. Terms of payment

a. The Customer shall pay the invoice price of the Goods or services (less any discount to which the Customer is entitled, but without any other deduction) 24 hours before the supply of contract services.
b. The time of payment shall be of the essence of the Contract.
c. Without prejudice to its rights the Lodge may (both before and after any judgement) charge interest at 4% per month on overdue balances.

6. Food

The Lodge reserve the right to amend final menus subject to seasonal availability of foodstuffs and replace it with similar or suitable alternatives. Notice of amendments will be made 24 hours before the supply of services.

7. Allergies

The Lodge cannot be held responsible for allergic reaction to any food content if the customer has not given notice of allergies. The Lodge will request information to be supplied at the point of booking.

8. Privacy

The Lodge is responsible for the safe and secure storage of customer data as per current legislation. The customer must not divulge confidential information of any sort to third parties outside of the agreement for the supply of goods and services.

9. Passing of title and risk.

Title to the goods & Services supplied by the Lodge (the 'Goods') shall not pass to the Customer until the customer has paid the Lodge :
i. the full purchase price of the Goods & Services;
ii. the full purchase price of any other goods or services supplied to the customer by the Lodge;
iii. any other sum which as at the date that payment is made for the Goods & Services is due to the Lodge by the customer;
b. Pending the passing of title to the Goods supplied to the customer, the customer undertakes to keep the Goods separate from any other Goods of the customer or any other supplier so that the same are readily identifiable as the property of thelodge and it shall be the duty of the customer at all times if so required to identify the Goods as the property of the Lodge.
c. The Lodge and its servants and agents may forthwith enter upon any premises or land occupied or owned by the Customer to remove the Goods if applicable..

10. Conditions & Warranties

The descriptions and illustrations shown in any brochure or online website at the time of going to press are to the best belief of the Lodge correct but the lodge reserves the right to make any modifications, improvements, alterations or any reasonable variations in the supply of any of the products or services so described whether for reason of availability of materials or components or for any other reason.

11. Representation

No employee or agent of the Lodge has any authority to vary these conditions and no statement, description, information, warranty, or recommendation contained in any catalogue, , advertisement, or made verbally by any of the Lodge's agents or employees shall enlarge, vary or override any of these Conditions.

12. Force majeure

The Lodge shall be entitled to delay or cancel provision of goods or services if and to the extent that it is prevented from or hindered in obtaining or supplying the Goods or services by normal route or means of delivery through circumstances beyond its control including (but not limited to) strikes, lock-outs, accidents, war, fire,  breakdown of plant or machinery or shortage or unavailability of materials from normal sources of supply.
